Terms of Service

1. Acceptance of Terms

By accessing or using the WyldTrace platform, website, or any associated services (collectively, the "Services") provided by WyldTrace Pvt. Ltd. ("WyldTrace", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms apply to all users of the platform, including harvesters, Forest Producer Organisations (FPOs), brand partners, and administrators.

2. Description of Services

WyldTrace provides a blockchain-based supply chain traceability platform for wild-harvested natural products. Our Services include:

• Harvester registration, profile management, and batch logging tools
• FPO management dashboards for verifying harvesters and overseeing collection areas
• Brand partner access to authenticated supply chain data and product traceability
• Blockchain recording of supply chain events for product authenticity verification
• QR code generation for consumer-facing product traceability
• Payment tracking and sustainability premium management

3. Eligibility

You must be at least 18 years of age to use our Services. By using WyldTrace, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement.

If you are registering on behalf of an organisation (such as an FPO or brand), you represent that you have the authority to bind that organisation to these Terms.

4. Account Registration

To access most features of the platform, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date registration information
• Keep your login credentials confidential and not share them with others
• Notify us immediately at info@wyldtrace.com if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are found to contain false information.

5. Acceptable Use

You agree to use the Services only for lawful purposes. You must not:

• Submit false, misleading, or fraudulent harvest data, batch records, or identity information
• Impersonate any person or organisation, or misrepresent your affiliation
• Attempt to gain unauthorised access to any part of the platform or another user's account
• Use the platform to facilitate any activity that violates applicable Indian or international law
• Upload malicious code, viruses, or any content that disrupts the platform
• Scrape, copy, or redistribute platform data without our express written permission
• Use the Services to harvest or collect personal information about other users

6. Accuracy of Data

You are solely responsible for the accuracy of any data you submit to the platform, including harvest quantities, species information, GPS coordinates, dates, and identity documents. Submitting false data constitutes a material breach of these Terms and may result in immediate account termination and legal action.

WyldTrace does not independently verify all submitted data in real time. Verification by FPO managers is a separate process and does not transfer liability for data accuracy from the submitting user to WyldTrace.

7. Blockchain Records

Certain supply chain events recorded through WyldTrace are written to a blockchain ledger. You acknowledge and agree that:

• Blockchain records are permanent and cannot be altered or deleted once confirmed
• Submitting a batch for blockchain recording is an irreversible action
• WyldTrace is not liable for errors in data that you have submitted and that have been recorded on-chain

8. Intellectual Property

All content, software, logos, trademarks, and technology on the WyldTrace platform are the exclusive property of WyldTrace Pvt. Ltd. or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Services for their intended purpose.

You must not copy, modify, distribute, sell, or reverse-engineer any part of the platform without our prior written consent.

By submitting content (including photos, notes, and harvest data) to the platform, you grant WyldTrace a non-exclusive, royalty-free licence to use that content to provide and improve the Services.

9. Payments

Payment terms between harvesters, FPOs, and brand partners are governed by separate agreements between those parties. WyldTrace provides payment tracking tools as part of the platform but is not a payment processor and does not hold or transfer funds on behalf of users.

WyldTrace is not liable for any disputes, delays, or failures in payments between platform participants.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. WyldTrace does not warrant that:

• The platform will be uninterrupted, error-free, or free of viruses
• Any information on the platform is accurate, complete, or current
• The platform will meet your specific requirements

To the fullest extent permitted by applicable law, WyldTrace disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, WyldTrace Pvt. Ltd. and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of data, revenue, profits, or business opportunities.

Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to WyldTrace in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if required by law.

You may terminate your account at any time by contacting us at info@wyldtrace.com. Termination does not affect blockchain records already created or legal obligations already incurred.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in India.

14. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify registered users by email. Your continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
